José Carles is a cross-border restructuring & insolvency attorney, chartered economist, and Court-appointed insolvency practitioner (“administrador concursal”). He is a founding partner of Spain-based CARLES. He led his previously co-founded firm's Cross-Border and Insolvency team to be recognized by GRR 100 as a top 100 global law firm for eight consecutive years, by Chambers & Partners, and nominated to European Restructuring Practice of the year by GRR 2025, highlingting his involvement in cases such as Intercement.
He has advised on many of Spain’s most significant restructuring and insolvency matters, including:
Defence of an ad-hoc group of bondholders in the Intercement case in Spain (on-going). This case has involved a coordinated team of lawyers in Brazil, US, The Netherlands and Spain, parallel proceedings and recognition involving UNCITRAL Model Law (Chapter 15 in US) or Spanish International Private Law rules (exequatur).
Creditor-forced insolvency petitions and litigation, being the only lawyer that forced the insolvency petition of companies of the Abengoa group, acting on behalf of several multinationals, French and Czech creditors, maximizing their recovery.
Distressed M&A transactions such as the pre-packs and pre-packaged sales of INV Protección, INV Sistemas, four companies of the Ingeser group, Aristoboard or Colvin or French company Monsieur Marguerite. The outcome: the businesses were saved, a high percentage of employees did not loose their jobs and counterparties to contracts did not lose their activity either
Restructuring plan of Grupo Aldesa, the first to include certain innovative shareholder's measures, including the success in the company's defence in Court against challenges of minority creditors.
Request for liability of directors such as the request for liability of directors of Abengoa representing a Saudi financial entity (on-going).
